THE FOLLOWING ARE THE TERMS OF SALE OF EG ITALIAN DESIGN LTD. READ CAREFULLY BEFORE PLACING AN ORDER FROM EMANUELGARGANOCOLLECTION.IT. PLEASE NOTE THAT THESE TERMS OF SALE INCLUDE THE ADDITIONAL TERMS INCORPORATED HEREIN BY REFERENCE.
APPLICABILITY
The following Terms of Sale refer to any (“Terms of Sale”) EG Italian Design Ltd. website, digital experience, social media platform, or one of our other products or services, all of which are part of EMANUELGARGANOCOLLECTION.IT Platform (“Platform”). These Terms of Sale create a legally binding agreement between the customer, EG Italian Design Ltd, and its affiliates (which we may refer to as “EMANUEL GARGANO COLLECTION,” “we,” “us,” or “our”) regarding orders placed for products available on the Platform. EG Italian Design Ltd may revise these Terms of Sale without notice by posting revised Terms of Sale on its Platform. Each customer should refer to the Terms of Sale posted on the Platform at the time of purchase. Please read these terms and the details of your order carefully before submitting your order. In case of any mistake, please contact us at: info@emanuelgarganocollection.it. Emanuelgarganocollection’s Terms of Use and Privacy Policy are incorporated herein by this reference.
PLACING ORDERS ON THE PLATFORM
ELIGIBILITY TO ORDER
To place an order on the Platform, you must be of legal age in your country.
HOW TO ORDER
You need an e-mail address to place an order, and you may need to set your browser to accept both (functional) cookies and pop-ups in order to be able to use all the functionalities of the Website, including adding items to your shopping cart and submitting your order.
Once each order is submitted, EG Italian Design Ltd will send an email including the acknowledgment of your order and a receipt. The email of acknowledgment and receipt of an order shall not, in and of itself, constitute acceptance of the order.
The order is accepted by EG Italian Design Ltd at the moment of shipment. EG Italian Design Ltd will send a confirmation email once the products have been shipped (“Order Confirmation”). Only at this moment a contract, containing these Terms of Sale, comes into existence and is binding on EG Italian Design Ltd and the customer (the “Contract”). Please print or download a copy of these Terms of Sale and the relevant Order Confirmation for future reference. If EG Italian Design Ltd is unable to complete an order, the customer is to be informed in writing of so.
OUR RIGHT TO REJECT YOUR ORDER OR CANCEL A CONTRACT
The fulfillment of all orders on the Platform is subject to availability. We explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel a Contract by written notice to you in the following cases, without being liable for any damage or costs other than repayment of any amount received from the customer in relation to the canceled Contract:
• the product is not available / in stock;
• the customer’s billing information is not correct or not verifiable;
• the customer’s order is flagged up by our security systems as an unusual order or an order susceptible to fraud;
• the customer’s bank transfer payment is not received within 12 calendar days after acceptance of your order;
• we believe the customer is under the legal age in their country;
• there was an error in the price displayed on the Platform;
• EG Italian Design Ltd could not deliver to the address provided by the customer;
• due to an Event Outside Our Control (see below); or
• in the event of misspelling, pricing, or other errors or mistakes in the Platform information.
DATA CHECK
Once orders are completed, EG Italian Design Ltd may run some checks on it before it is fulfilled. These checks may include verifying the customer’s address and checking for fraud. We run partly automated checks on all purchases to filter out unusual or suspect transactions, or transactions that can be identified as susceptible to fraud. Suspected fraud on the Platform will be investigated and if necessary prosecuted.
TITLE TRANSFER
The risk of loss and title for products purchased from emanuelgarganocollection.it pass to the customer upon delivery to the carrier.
PRICE/PAYMENT
PAYMENT METHODS
EG Italian Design Ltd accepts the following payment methods:
• Visa, MasterCard, American Express, Discover
• Stripe
• PayPal
• Bank transfer
The updated available payment methods for each country are in the help section of emanuelgarganocollection.it (the “Website”). We do not accept any method of payment other than those listed in the help section. Any other payment methods will not be accepted. If a customer forces another payment method on the system, EG Italian Design Ltd will not be liable for any loss of the payment or any other damages that may result from this action.
PAYMENT PROCESSING
Except with respect to pre-ordered products, if the customer pays by credit/debit card, EG Italian Design Ltd will deduct the amount due from the customer’s account as soon as the placed order leaves the warehouse. If the customer pays by bank transfer, we will start delivery after the payment is received. This may take several days. In the event that no payment has been received within 12 calendar days after you submitted your order, your purchase will automatically be canceled. Payments can only be processed if the billing information can be verified.
PRICES AND CURRENCY
The product prices displayed on the Platform are inclusive of Value-Added Tax (VAT), as applicable. Shipping rates are applied per order. The exact shipping rates depend on the country where the customer’s order is being delivered to.
Prices are quoted in GBP (Great Britain Pounds).
YOUR TOTAL PRICE
The total price specified in the final check out screen includes tax and shipping costs. This price will be recorded in the Order Confirmation. Please print download it for future reference. If paying by credit card, the total amount for your entire order will be reflected on your statement in your local currency.
If the customer’s local currency is different from the currency in which the prices are quoted, the customer’s bank will apply the exchange rate applicable per the date of purchase. The customer’s bank may apply a different exchange rate, which is beyond our control.
PRICE CHANGES
The prices of the products will be as displayed on the Platform. Prices may change from time to time, but changes will not affect any confirmed order that has been confirmed in an Order Confirmation.
SHIPPING & DELIVERY
DELIVERY TIMING
Shipping timing may vary approximately from 5 to 6 weeks, depending on the product chosen, the country of destination, the availability in stock and the courier used.
DELIVERY – WHERE AND WHEN
We do not ship on certain public holidays. We can only fulfill an order to be delivered at a home or office address. We do not accept orders to PO boxes.
SPLIT DELIVERY
Where possible, we deliver all ordered items at the same time. However, please note that due to the fact that customized products are manufactured at different factories and times, an order for multiple customized products may result in split shipments.
We reserve the right to split the delivery of your order, for instance, if part of your order is delayed or unavailable. In the event that EG Italian Design Ltd splits your order, the customer will be notified via e-mail to the e-mail address provided at the time of placement od the order. The customer will not be charged for any additional delivery costs.
INSPECTION UPON DELIVERY
Upon delivery, please inspect the packaging for damage. If it appears that the packaging is damaged, please do not accept the shipment.

Shipping costs may vary according to the goods purchased and the country of reference.
RETURNS & CANCELLATIONS
CANCELLING ORDER BEFORE DELIVERY
The customer may cancel any order free of charge and with no explanation, provided it has not yet been shipped. We begin processing orders placed in our online store almost immediately. If you wish to cancel your order, please check the status of your order first by visiting the “Order Status” link on the Website.
If the status of your order is “Pending” or “On Hold” you may cancel your order by contacting our call center or emailing us. Our customer service agents will request a cancellation of your order at our warehouse. If successful, they will send you an email and the cancellation will be free of charge. If cancellation is not possible, the product(s) will be delivered to you and may be returned in accordance with the procedure set out below.
Customized orders cannot be canceled before shipment, because EG Italian Design Ltd starts producing the customized products immediately after receiving the order. The customer is entitled to return their order in accordance with the return procedures and conditions below.
RETURNING ORDERS AFTER DELIVERY – DEFECTIVE PRODUCTS
The customer is entitled to return delivered products in the event that they are defective or otherwise not in conformity with the customer’s order once they are received. This does not affect your statutory rights. In the event the customer’s claim is justified, the purchase price and the shipping costs will be refunded. REFUND INFORMATION
Refunds will be issued based on the original form of payment. If the customer paid via bank transfer they need to give this information to Customer Service when the return is initiated so that EG Italian Design Ltd can refund the money directly to your account.
